A lot of business owners hear about CIPA lawsuits and have the same reaction: “That’s what insurance is for.”
It’s an understandable assumption. But it’s also one that leaves businesses far more exposed than they realize, since insurance doesn’t work the way most people expect when a CIPA claim arrives.
The Coverage Gap Is Real
General liability insurance almost never covers CIPA claims. These are statutory privacy violations, not physical harm or property damage. Most GL insurers deny CIPA claims outright, and the policy language supports that denial.
Cyber liability policies are closer, but still unreliable for CIPA specifically:
- Many cyber policies are written around data breaches, not civil privacy claims
- CIPA claims don’t require a breach, which can put them outside policy scope entirely
- Some policies cover regulatory fines but not civil demand letters or settlements
- Newer policies increasingly include exclusions written specifically for tracking-related claims
Business owners who call their broker after receiving a demand letter often find out for the first time that their coverage doesn’t apply the way they assumed.
Even When Insurance Helps, It Doesn’t Fix the Problem
Say your policy does cover defense costs. That’s genuinely useful. But here’s what insurance still doesn’t do:
- It doesn’t remove the tracking scripts creating the exposure
- It doesn’t stop the next demand letter from arriving
- It doesn’t prevent a class action if the same issue affects multiple visitors
- It doesn’t protect your reputation during a drawn-out legal process
Settling one claim through insurance while leaving the underlying problem in place means you’re still a target. The bots that found you once will find you again.
Insurance Is a Response Tool. Prevention Is the Strategy.
This is the core issue with relying on insurance for CIPA exposure. Insurance is designed to help you recover after something goes wrong. It was never designed to stop the problem from happening in the first place.
Prevention is simpler and less expensive than most business owners expect:
- Audit which tracking scripts are active on your site
- Confirm whether those scripts fire before or after visitor consent
- Verify that opt-out signals reach every connected vendor
- Remove scripts from old campaigns that have no reason to still be running
Most of these fixes require configuration, not new tools or new budget. They just require someone to look.
How Social Spice Media Can Help
We help businesses find and close the gaps that create CIPA exposure — before a demand letter makes the question urgent. That means reviewing your full tracking setup, testing your consent flows, and giving you a clear picture of what needs to change.
That conversation is far less expensive than a legal defense, and far more certain than hoping your cyber policy applies.
